Acceptance of Terms

By accessing or using PaintMyMap ("the Service"), including our website at paintmymap.com, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service.

Description of Service

PaintMyMap is an interactive map creation tool that allows users to:

• Create custom color-coded maps of countries, regions, and territories
• Paint and annotate geographic features with colors, patterns, and labels
• Build legends and add titles to maps
• Draw shapes, lines, arrows, comments, and annotations
• Import custom geographic data (GeoJSON, TopoJSON, Shapefiles, KML, CSV)
• Import and place custom SVG graphics
• Choose from various map projections
• Edit and transform map features
• Export maps as PNG, JPG, SVG, or PDF

Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

License and Restrictions

Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes, subject to these Terms.

Prohibited Uses

You agree NOT to:

• Use the Service for any illegal purpose or in violation of any laws
• Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission
• Modify, reverse engineer, decompile, or disassemble any part of the Service
• Use automated systems (bots, scrapers, crawlers) to access the Service without authorization
• Interfere with or disrupt the Service or servers/networks connected to the Service
• Attempt to gain unauthorized access to any part of the Service, user accounts, or computer systems
• Remove, obscure, or alter any copyright, trademark, or proprietary notices (including watermarks on exported maps)
• Use the Service to transmit viruses, malware, or harmful code
• Impersonate any person or entity or misrepresent your affiliation
• Collect or harvest personal information about other users
• Use ad-blocking software that interferes with the Service's functionality or revenue model

Geographic Data

• Map data is sourced from OpenStreetMap and other geographic data providers
• You are responsible for verifying the accuracy of any data displayed
• Territory boundaries and names may be disputed and are shown for educational purposes only
• Maps you create are your own work, but must comply with applicable copyright laws if you use third-party data

User Content

Content You Upload

When you import custom geographic data files or SVG graphics:

• You retain all rights to your content
• You grant us a limited, worldwide, non-exclusive license to process and display your content within the Service for the purpose of providing map creation features
• You represent that you have the right to upload and share this content
• We are not responsible for the accuracy or legality of user-uploaded content
• We do not claim ownership of your uploaded data or created maps

Maps You Create

• Maps you create using PaintMyMap are your own work
• You retain all rights to your created maps and exported files
• Exported maps may include a "Created with PaintMyMap.com" watermark (which you may remove for personal use)
• For commercial use of exported maps, you agree to provide attribution to PaintMyMap.com or keep the watermark intact

Project Files and Autosave

• Project data is saved locally in your browser
• We do not have access to your locally-stored project files
• You are responsible for backing up your work
• Clearing browser data will delete your saved projects

Analytics and Advertising

Analytics

We use analytics tools (including Google Analytics and similar services) to:

• Track usage patterns and service performance
• Understand user behavior and feature adoption
• Improve the Service and user experience
• Generate anonymized statistics about map creation and exports
• Monitor errors and technical issues

Advertising

The Service may display advertisements to support free access:

• We partner with third-party advertising networks (including Google AdSense and others)
• Ads may appear on the website, within the map creation interface, or on exported content
• Ads may be personalized based on your browsing activity, interests, and demographics
• Third-party advertisers may use cookies, web beacons, and similar technologies to collect information
• You may see ads before, during, or after using features
• Ad blockers may affect Service functionality and your ability to use certain features
• We do not control the content of third-party advertisements and are not responsible for their accuracy or appropriateness
• By using the Service, you consent to the display of advertisements as a condition of free access

Advertising Opt-Out

• You may opt out of personalized advertising through your browser settings or ad network preferences
• Opting out of personalized ads does not mean you will see no ads; you will still see contextual advertisements
• Some ad networks provide opt-out mechanisms at youradchoices.com and aboutads.info

Intellectual Property

Our Rights

All content, features, and functionality of the Service, including but not limited to:

• Software code and architecture
• User interface design and graphics
• Logos, trademarks, and brand elements
• Map creation tools and algorithms
• Documentation and tutorial content
• Built-in map datasets and projections

...are owned by PaintMyMap or our licensors and are protected by copyright, trademark, and other intellectual property laws.

Geographic Data

• OpenStreetMap data is available under the Open Database License (ODbL)
• Satellite imagery is provided by respective tile services
• Historical territory data is compiled from public domain sources
• Individual country flags and symbols are subject to their respective copyrights

Trademarks

"PaintMyMap" and related marks are trademarks of PaintMyMap. You may not use our trademarks without prior written permission.

Third-Party Services

The Service integrates with third-party services:

• Map Data Providers: OpenStreetMap and other geographic data providers
• Analytics: Google Analytics and similar analytics services
• Advertising Networks: Google AdSense and other ad networks and exchanges
• CDN and Hosting: Content delivery and cloud infrastructure providers
• Export Services: Browser-based rendering engines for PNG, JPG, SVG, and PDF generation

Your use of these third-party services is subject to their own terms and policies. We are not responsible for third-party services, their content, or their data practices.

Disclaimers

"AS IS" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Accuracy

• Geographic data may contain errors or inaccuracies
• Territory boundaries shown are for educational and visualization purposes and may not reflect current political boundaries
• Built-in map datasets are sourced from publicly available geographic data
• We do not guarantee the accuracy, completeness, or timeliness of any information
• You are responsible for verifying any data used in maps for professional or commercial purposes

Availability

We do not guarantee that:

• The Service will be uninterrupted, secure, or error-free
• Defects will be corrected
• The Service is free from viruses or harmful components
• Results obtained from the Service will be accurate or reliable

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• WE SHALL NOT BE LIABLE FOR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• OUR TOTAL LIABILITY SHALL NOT EXCEED $100 USD OR THE AMOUNT YOU PAID TO US (IF ANY) IN THE PAST 12 MONTHS

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

Indemnification

You agree to indemnify, defend, and hold harmless PaintMyMap, its officers, directors, employees, agents, and advertising partners from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your uploaded content or created maps
• Your commercial use of exported maps without proper attribution
• Any dispute regarding the accuracy or legality of maps you create

Geographic and Political Neutrality

• Territory boundaries and names shown are for educational and illustrative purposes
• Display of any territory does not imply political endorsement or recognition
• We acknowledge that borders and territorial sovereignty are subject to international law and may be disputed
• Users should refer to official sources for authoritative geographic and political information

Modifications to Service

We reserve the right to:

• Modify, suspend, or discontinue any part of the Service at any time
• Change features, functionality, or available map projections
• Update geographic data, maps, and territory information
• Impose limits on usage, exports, or file uploads
• Require software updates for continued access
• Modify or remove advertising placements and formats
• Introduce paid features or premium tiers

We are not liable for any modifications, suspensions, or discontinuations.

Modifications to Terms

We may update these Terms from time to time. Changes will be effective when posted with an updated "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

Material changes will be communicated through:

• Update to the "Last Updated" date
• Other reasonable means

Termination

By You

You may stop using the Service at any time. Your data stored locally in your browser will remain until you clear it.

By Us

We may terminate or suspend your access to the Service:

• For violation of these Terms
• For illegal or fraudulent activity
• For circumventing advertisements or payment systems (if applicable)
• For excessive or abusive use that impacts Service performance
• At our sole discretion for any reason
• Without notice or liability

Effect of Termination

Upon termination:

• Your license to use the Service immediately ends
• You must cease all use of the Service
• Your locally-stored project data remains in your browser but cannot be accessed via the Service
• Provisions that by their nature should survive termination will survive (including indemnification, disclaimers, and limitations of liability)

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be resolved through:

1. Informal negotiation
2. Binding arbitration (if negotiation fails)
3. Courts with jurisdiction in our designated location (if arbitration is unavailable)

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TrueSize regarding the Service and supersede any prior agreements.

No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

Special Provisions

Educational Use

Teachers and educators may use the Service in classroom settings. We encourage educational use but ask that you:

• Credit PaintMyMap.com when sharing maps with students
• Do not redistribute our software or content as your own
• Comply with all other Terms

Commercial Use

You may use maps created with PaintMyMap for commercial purposes provided that you:

• Provide clear attribution to PaintMyMap.com (e.g., "Created with PaintMyMap.com")
• Keep any watermarks intact on exported maps, OR
• Obtain written permission from us to remove watermarks

For white-label or enterprise licensing, contact us to discuss arrangements.

Research and Academic Use

Researchers may use the Service for academic purposes. We ask that you:

• Cite PaintMyMap in publications (e.g., "Maps created using PaintMyMap.com")
• Comply with all applicable research ethics guidelines
• Verify the accuracy of geographic data for scientific purposes
